  • Catering License

  • If you plan on offering catering services as part of your business, a catering license may be required. This often involves additional health department inspections to ensure your catering operations meet health and safety guidelines.
  • Health Department Permit

  • This permit is crucial for any food service establishment. Obtaining it typically involves an inspection from the health department to ensure your business complies with local health codes and regulations.
  • Zoning and Land Use Permits

All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) food business doing business under an assumed business name in Bedford County i.e. you are a business that uses a DBA doing business as trade name to trade that is other than the full legal (first and last -- full name) name of a sole proprietor or a name other than the LLC or Corporation business name need a(n) assumed business name certificate.   E.g. you venture into a(n) food business and you give it a trade name such as "Excellence food & Associates". You will need to register an assumed business name certificate.

In Tennessee you need a resale ID ( AKA seller's permit) if you selling touchable items.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
    Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

In addition you will need a federal and a state EIN if you will hire employees. I.e., a TN Federal Tax Id Number ($29)  and a(n) TN  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Shelbyville, Incorporate in TN  or form a(n) TN LLC

Filing a DBA is not required if you will set up an LLC or form a Corporation. If you will do business under your first and last legal name you will not need to get a fictitious business name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.

If you do form an Retail Trade llc or incorporate (about $49 plus state fees for most states) your food business instead of just filing a fictitious business name (dba), that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Shelbyville business name. In lieu of recording a Bedford County trade company name (our filing service fee includes trade name registration and newspaper legal publication for 4 weeks) you can also form a corporation in Tennessee or form an TN LLC (starts @ $49 plus state fee for most states & includes bylaws for the corporation and Limited Liability operating agreement for the LLC that is required to open a business bank account). .

    About Your Business Type

    Food

“Life is uncertain. Eat dessert first.” – Ernestine Ulmer

Food businesses include: Restaurants, Fast Food, Homemade Food, Catering, Food Trucks, Mobile Food Vendor, Food Carts, Coffee Shops, Catering, Food Stands, Bars that Serve Food, Carry-out restaurants, Pizza Restaurants, Pizza Taco Stands, Grocery Stores.

Q:Selling food from home. Meals include cooked meat, pasta, and veggies. Food prepared in a home kitchen

ANSWER: Hi Alisa, yes, you can open a Deep Fried Turkey Catering and the good news is that catering from home is ok. Namely, Homemade Food (HMF) sales are allowed, but you can only make food that is not potentially hazardous.

Operators can use their home kitchen to produce products to sell directly to consumers.

However, keep in mind that homemade food sales by internet, mail order, consignment or at wholesale are not allowed.

Regardless, homemade food is subject to sales tax, so you will need to register a seller's permit.

That being said, you still need to register your business name "Uncle O"S Deep Fried Turkey," with a DBA, LLC or a corporation, get an EIN, a business license and if hiring a state EIN as well.

That said, everything else is like any other business.

For example, you need to select a legal structure such as LLC or partnership, and obtain a certificate for that structure.

Selling food to the public in a food cart. Self-employed, at a location not at home. I am working on a location. Do I need licensing for mobile food?

ANSWER: Hi Brian, food businesses need all licensing like any other business as described below.

However, food businesses also need another type of permit or license, and that is a health permit.

That means that after you apply for all licensing here, then they will ask you to get a health permit as well.

That means that the city inspector has to come and take a look at whether the food and food service preparation and serving areas comply with current hygiene regulations.

For example, your food premises or mobile truck, trailer or cart, must comply with the FDA Food Code, which is a “model” code (guideline) that provides over 3000 local, state, tribal and federal food control agencies scientifically sound food safety information that follows national food regulatory policies such as following four simple steps—clean, separate, cook, and chill, which can help protect from food poisoning.

Here is a quote about food: "People who love to eat are always the best people." "Eating is a necessity, but eating intelligently is an art." "We all eat, and it would be a sad waste of opportunity to eat badly." "If you really want to make a friend, go to someone's house and eat with him...the people who give you their food give you their heart."

That said, yes, you do need licensing.

First, "Bite Me Main Mobile Food, LLC," requires the creation of 2 legal documents:

One is the LLC certificate that has to be registered with an official article of organization, and the other, is the preparation and execution(singed and notarized but notarization not absolutely necessary) of an LLC operating agreement.

You need to set up an LLC because the suffix LLC denotes that you are an LLC.

If you don't want the "LLC" suffix, you have 3 more options for selecting your legal structure.

So, other than the LLC, you can select to be:

    1. Sole proprietor,
    2. Partnership,
    3. Corporation.

So, you may want to be a corporation with an "Inc" suffix or a sole proprietor or partnership without any suffixes.

That said, regardless of which structure you select, you still need at least a business license and an EIN.

That is not all, however. Because food when sold is subject to sales tax, you need to obtain a seller's permit that you can use to collect the sales tax for each sale and then remit the tax to the State quarterly or however the State decides that you have to remit it, which it could also be semi-annually or annually.

The seller's permit can also be used to buy any prepared food, such as chips bags, or jars of food, wholesale. In most states, raw food is not subject to sales tax.

Finally, hiring food workers to prepare and or to sell the food, requires a federal EIN and a State EIN as well because you need to remit and report employment taxes to both the federal and state government.

Employees pay half of their Social Security and Medicare taxes. The employer must pay the other half.

This means they pay 5.65 percent of employee wages for these taxes and withhold the employee’s tax and pay that as well to the government(s).

    LLC (Limited Liability Company) FAQs:

Q: Is setting up an LLC a better choice than filing a DBA?

A: If the business market projection is a target fot the company you should consider forming an LLC. For example if the assumed business name is . deMonica Moldertch Amber's Ocean Ice ShackCo. this name as well as any other name is an assumed business name and it must be recorded as a DBA Doing Business As name which also requires a fee to be recorded.

A trade registration is requred but if the owner wants to use the business name exclusively he or she cannot because anyone else can also file the same trade name. Nor does the trade name registration protects the owner from personal legal or financial liability as forming a limited liability company (LLC) . It is perhaps a better choice to just incorporate for the same or a little higher fee because you will also have corporate protection for the business name and personal vs business liabilities.

E.g. if your business has debts the lender can sue you personally to obtain a judgment vs your personal assets as opposed in the case you were a corporation where the lender could only sue the corporation directly and if the limited liability company (LLC) had no assets the lender could get nothing.

Note that once you incorporate no one can register the limited liability company (LLC) name at the state level.

Q: Can I apply by phone and set up a limited liability company (LLC)?.
A: You can apply by phone but the best way is to just fill out our online limited liability company (LLC) form.

Q: Does an LLC without employees need a tax ID number?
A: An LLC without employees may not need a tax ID number but an LLC with more than one owner does need one. In addition if the LLC is engaged in selling taxable items such as clothing it will need a sales state tax ID number in addition to any other tax ID.

Q: What if I an an out of state business? Do I still need to register and obtain a limited liability company (LLC)?
A: Unless you have a location in the state you sell it is not required to form an LLC there.

Q: When do I have to change my limited liability company (LLC)?
A: You may have to get a new tax ID number if your status as a business changes. For example if you change from sole owner to a partnership or from LLC to corporation as well as when you buy a new business you need to get a new tax ID under your business name or individual name.

Q: Do I need to obtain a federal or state tax ID number before forming a limited liability company (LLC) or getting other licenses?
    A:

Q: What are the benefits of havin a DUNS number?
A: You can use it to your benefit by providing favorable business information to make it more likely to get a loan from a lender bank.

Q: Do I need to pay sales tax to the state as an LLC?
A: Paying sales tax depends on your state. For example in Oregon you dont need to pay sales tax but you still need a resale certificate to buy from other states wholesale products.
